Wills & Enduring Powers Of Attorney

We prepare wills and enduring powers of attorney (EPAs).  Specifically, both property EPAs and personal care and welfare EPAs  that are customised to your individual requirements.

With almost 30 years in practice, our firm brings considerable depth of experience to trust and estate matters, helping clients navigate the often complex intersection of property law, trust law and complex family circumstances.

Buying a Property

In New Zealand there is limited protection for buyers of homes and apartments and other property (i.e. buyer beware). It is important to have a purchase agreement with the correctly worded conditions included. We recommend you telephone us before you sign a purchase agreement. We can then ensure that the agreement gives you the required protection. After signing of the agreement we will work with you to ensure that all the appropriate checks and enquiries are made.

Selling a Property

With the growing emphasis on building and compliance issues you need to be sure when selling your home that you do not give the purchasers the opportunity to claim compensation from you or to claim that the title is defective. Telephone us and check these matters when you put your home on the market for sale or before signing a sale agreement.

Trusts / Companies / Partnerships

We are experienced in property protection issues and can discuss with you (and your tax advisors) the different ownership options. Richard Middleton is our trusts lawyer. His focus is on ensuring that any trust arrangements are as simple and as cost effective as possible and that ownership arrangements are properly co-ordinated with the completion of Wills and other documents.

We can also advise you on the laws which apply to de facto relationships and marriages and on what is required to protect your assets in this regard.
